CROWNTONKA warrants to the original purchaser the foamed-in-place panels manufactured and sold by it to be free from defects in material and workmanship under normal use and service for a period of five years from the date of original installation by an authorized representative, but not to exceed 5 years and six months from date of original shipment. Painted surfaces shall be warranted against defects in materials and workmanship under normal use and service for a period of one year. All hardware [except refrigeration system, covered separately] are warranted against defects in materials and workmanship under normal use and service for a period of one year from date of installation, but not to exceed fifteen months from date of original shipment.
CROWNTONKA will repair or exchange, at its option, any panels manufactured or sold by it [exclusive of lights, door heaters and other expendable electric components] which prove to be defective within the warranty coverage. Inspection by CROWNTONKA of parts claimed defective shall be final in determining warranty status. The warranty does not include transportation charges to and from, nor the cost or responsibility of removing the defective part or reinstalling the replacement or repaired part and will not apply to said equipment nor any part thereof which has been subject to misuse, damage in transit, accident, negligence or alteration and will not apply if said equipment is located outside the Continental United States. With respect to products sold or supplied by CROWNTONKA, but manufactured by others, CROWNTONKA'S sole obligation is to assist the original purchaser in contacting said manufacturer. In no event shall CROWNTONKA be liable for loss of use, revenue or profit or for any other indirect, incidental, special or consequential damage including, but not limited to, food spoilage or product loss.
THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES WHETHER WRITTEN, ORAL, STATUTORY, EXPRESS, OR IMPLIED [INCLUDING ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL WARRANTIES ARISING FROM COURSE OF DEALINGS DR USAGE OF TRADE]. It shall be CROWNTONKA'S sole and exclusive liability and Buyer's sole and exclusive remedy for action, whether based in contract, in tort, [including negligence], strict liability or otherwise. Upon expiration of the Warranty period all such liability shall be terminated.
In order to exercise this warranty, the Buyer must notify CROWNTONKA in writing immediately upon knowledge of a problem. Failure to notify CROWNTONKA voids this warranty.
